Separation

If you are divorcing your partner or ending a registered partnership, it will affect your pension. Make good arrangements in this regard. It is recommendable to ask an advisor about this.

Your former partner will be entitled to half of the retirement pension you accrued during your marriage or registered partnership. This is known as ‘equalisation’. You can also make alternative arrangements. Lay down your arrangements in your marriage settlement, partnership, or divorce agreement.

What do you need to arrange for your pension if you are going to separate?
It is important to arrange a few things immediately:

Deregister your partner with us
Use the Sign out partner form (pdf) to do this. You only need to deregister your partner with us if you were cohabiting with a cohabitation agreement or if the separation or termination of your registered partnership occurred outside the Netherlands.

Let us know if you want us to pay pension to your former partner
Would you like us to arrange the division of your old-age pension? Then you will need to inform us of this within 2 years after your divorce using Mededelingsformulier in verband met verdeling van ouderdomspensioen bij scheiding (a notification form that specifies how retirement pension is to be divided following a divorce) of the Dutch government. If you decide not to do so, you will have to pay the pension to your partner yourself every month.

Notify us of an alternative division of your pension
Include the alternative division in the notification form. Send us the form and also send us a certified copy of the following pages from your marriage settlement, partnership or divorce agreement:

  • the 1st page with the names of you and your former partner
  • page with your pension agreements
  • last page showing the signatures of you and your former partner

Married and/or divorced outside the Netherlands? Send us additional documents
In addition to the marriage settlement, partnership or divorce agreement please include a (certified) copy of:

  • your marriage or partnership certificate; and/or
  • evidence of the divorce or termination of the registered partnership
